These Terms of Service ("Terms") govern your access to and use of the website operated by Scranton Magnets LLC (doing business as Kitty Pic Magnets), and the purchase of any products sold through it (the "Site"). By using the Site or placing an order you agree to these Terms.

Custom & Personalized Products

Many items sold on the Site are made to order using photos and personalization text supplied by you. Because each item is produced individually:

  • Minor variations in print color, alignment, cropping, sheen, or finish are inherent to custom production and do not by themselves indicate a defective product.
  • Once production begins, an order cannot be modified or canceled.
  • All sales of personalized items are final, subject to the remake and damage-resolution terms set out in our Returns & Refunds policy.

User-Submitted Content — Your Photos & Text

When you upload photos or submit personalization text (collectively "User Content"), you represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use the User Content for the purpose of producing your order.
  • The User Content does not infringe any copyright, trademark, right of publicity, right of privacy, or any other right of any third party (including, without limitation, characters or images owned by entertainment, media, or sports organizations).
  • The User Content is not obscene, defamatory, hateful, harassing, or otherwise unlawful.

We reserve the right, but have no obligation, to refuse to produce any order whose User Content we reasonably believe violates these Terms or applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Scranton Magnets LLC and its officers, employees, contractors, and agents from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) any claim of copyright, trademark, right of publicity, right of privacy, or other intellectual-property infringement based on your User Content; (c) your violation of these Terms; or (d) your violation of any law or right of a third party.

Orders & Acceptance

Your submitted order is an offer to buy. We may accept, decline, or limit any order at our discretion, including in cases of pricing errors, suspected fraud, or stock issues. A binding contract is formed when we send the order-confirmation email. Please note that if you are using our "buy now, upload later" feature, our production timelines do not commence until you successfully submit your User Content.

Pricing & Payment

All prices are shown in USD (U.S. Dollars) unless otherwise stated. Accepted payment methods are shown at checkout. Applicable sales tax is calculated and disclosed before payment.

Shipping & Delivery

Delivery is subject to our Shipping Policy. Estimated delivery times are provided by carriers and are not guaranteed by us, particularly for made-to-order products with an additional production window.

Intellectual Property — Site Content

All content on the Site (other than User Content) — including logos, product imagery, copy, and software — is owned by or licensed to Scranton Magnets LLC and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may not reproduce, modify, distribute, or publicly display any such content without our prior written permission.

Relationship with Shopify

The Site is hosted on the Shopify platform, operated by Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to sell our products to you. Your interaction with the Site is also subject to any applicable Shopify terms; nothing in these Terms transfers responsibility for the platform itself to Scranton Magnets LLC.

Disclaimer of Warranties

The Site and products are provided "as is" and "as available" without warranties of any kind, either express or implied, except those that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, Scranton Magnets LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Site or the products. Our total aggregate liability shall not exceed the amount you paid for the order giving rise to the claim.

Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

Prohibited Uses

You agree not to use the Site to: (a) violate any law or regulation; (b) infringe the intellectual-property or other rights of any party; (c) interfere with the operation of the Site; (d) attempt to access non-public areas of the Site or systems; or (e) submit fraudulent orders or false personalization information.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States and of the State of Pennsylvania, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in the State of Pennsylvania, unless a mandatory consumer-protection law of your state of residence requires otherwise.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Site with a new "Last updated" date. Continued use after changes constitutes acceptance.
